According to the Greek Government Gazette 3118 B /2013 – Definition of the technical specifications for authorizing self-sufficient accommodations, the authorization process of self-sufficient accommodations is simplified (furnished mansions, villas and homes).

  1. Touristic furnished villas

As touristic furnished villas are considered to be all detached houses, of at least 100m2 surface, which have independent external access, they present autonomy of land and building, and they are not basic touristic accommodations, according to the meaning of the article 2, Law 2160/1993, with no provision of services. Also, they are constructed according to the same regulations as houses.

Touristic furnished villas are not categorized into classes. They can be rented for daily use, except for the case of the paragraph 5 of the article 46 of the 4179/2013, which gives the opportunity to rent such villas at least for a weekly use and not for more than a total of three months in a year.

  1. Touristic furnished houses

As touristic furnished houses are considered to be all houses, either individual or part of a complex, of at least 40m2 surface each, which are independently functional and with independent external access. They are constructed according to the same regulations as houses.
Maximum permitted houses per land: Ten (10).
Touristic furnished houses are not categorized into classes and they can be rented for daily use.
This means: You choose one quarter of the year but not partially (ex. touristic periods of great demand: Easter, Christmas, Assumption)!

LAND SPECIFICATIONS TO BUILD SELF-SUFFICIENT ACCOMMODATIONS

1.Land location

The land must be accessible and not neighboring to bothersome establishments.

2. Land area

2.1 The land area, where the self-sufficient accommodation exists or is about to be built, has to be undivided and owned jointly by one or more owners (natural or legal persons or local authorities). Of course, the total of the ownership rates must cover the 100% of the area.
2.2 The issue of the special operational mark registration for E.O.T. self-sufficient accommodations is forbidden for a single owner of a jointly owned property, unless the rest of the owners agree to that issue.
2.3 In case of land, where a vertical property has already been constructed, the construction of a self-sufficient accommodation is allowed given that there is no forbidding rule neither in the relevant document of establishment nor in the ownership regulation.

COMMON TECHNICAL – OPERATIONAL SPECIFICATIONS OF SELF-SUFFICIENT ACCOMMODATIONS

1. Any configuration work of the external environment must be completed.

2. The areas of the self-sufficient accommodations must have the necessary furniture and clothing equipment, including the kitchen and bathroom equipment.

TECHNICAL – OPERATIONAL SPECIFICATIONS PER CATEGORY OF SELF-SUFFICIENT ACCOMMODATIONS

I .Touristic furnished villas

1. Touristic furnished villas must have a minimum of 100m2 surface.

2.The creation of a touristic furnished villa in a land, where there have been already constructed or will be constructed other houses, is allowed in one condition: the autonomy of the villa has to be ensured by giving the right of exclusive use of the external environment and independent access.

II. Touristic furnished houses

1. Touristic furnished houses are divided into:

a .Individual houses of total minimum surface of 40m2: they include at least one main area of bedroom - living room – kitchen use and a bathroom.

b. Houses of two or more main areas, of total minimum surface of 60m2: they include at least one area of living room use, one area of bedroom use, one bathroom and a kitchen area, which can be included with the living room.

2.In case of touristic furnished houses which are developed in house complexes or detached houses, the external environment along with its supplements and components, and swimming pools included, can service all the touristic houses of the land. The right to use exclusively the external environment for each of the touristic furnished houses separately, is not precluded.

3.In a complex of touristic furnished houses, one of the houses is allowed to be used exclusively by its owner, under the condition that this house will not be included in the special operational mark.

4. In a complex of touristic furnished houses, it is possible to have communal establishments of swimming pools, sports, restaurants and reception for the residents of the houses.

5. In a complex of ten touristic furnished houses, at least one of the houses must fulfill the specifications described in the Law 4067/2012 concerning persons with reduced mobility.

PROCESS AND SUPPORTING DOCUMENTATION TO ISSUE A SPECIAL OPERATIONAL MARK REGISTRATION FOR E.O.T. SELF-SUFFICIENT ACCOMMODATIONS

To issue a Special Operational Mark for a touristic furnished villa, we file at the competent .E.O.T. office the supporting documentation which is described in the paragraph 2, article 46, Law 4179/2013 as follows:

a. Application - formal declaration of the article 8, Law 1599/1986 (Greek Government Gazette 75 A’), filled with the data of the applicant natural or legal persons, the tax identification number and the competent tax office. In case of legal persons, the application is filed from its legal representative and includes the documents that prove its legal foundation and operation.

b. Topographic diagram of the land designed by an engineer, member of the Hellenic Technical Chamber, which is filed in two copies on a 1:500 or 1:200 scale.

b1.   The responsible engineer confirms the location of the land (municipality – area), its surface area, how it is accessed, he imprints the accommodation by the tag “constructed”, he marks the existing villa and any existing swimming pools, and confirms the number of rooms and beds.
b2.   The property title and the building permit or building authorization based on which the building has been constructed are mentioned as well as the parts that maybe have been settled or preserved according to the relevant building legislation.

c. A copy of the building permit or building authorization and, depending on the case, the rest of the statutory documents of the case (c), paragraph 1, article 150, Law 4070/2012 as applied.

d. A fire protection certificate concerning the entire establishment, which is issued by the competent fire department, for touristic furnished villas of more than  twenty (20) beds, according to the case (d), paragraph 1, article 150, Law 4070/2012 as applied.

e. A formal declaration by a mechanical engineer or electrical engineer or energy technology engineer or chemical engineer or of relevant specialty graduate or qualified engineer, either concerning the establishment’s adequacy for health waste disposal according to the applied legislation or concerning the connection with the municipality’s sewerage network.

f. Formal declarations, according to the article 8, Law 1599/1986 (Greek Government Gazette 75 A’):

f1.   By the applicant or the representative engineer, confirming that the accommodation is built and fulfills all the technical and operational specifications (which are described in this ministerial decree) concerning the land and building.
f2.   By the applicant, confirming that he is the owner of the land displayed in the topographic diagram.
In case of more than one owners of a jointly owned property, there have to be filed either separate declarations or a joint one with the owners data, each owners percentage of joint-ownership and their consent for the issue of the Special Operational Mark to the applicant.  In case a vertical property has already been constructed in the land, the relevant document of establishment and the property’s co-owners regulation have to be presented, to help confirm that the specific use of the property is not forbidden.

g. Proof of fee payment, according to the case (h), paragraph 1, article 150, Law 4070/2012, as applied.

2. To issue a Special Operational Mark for a touristic furnished house, we file at the competent E.O.T. office the following documents:

a. Application - formal declaration of the article 8, Law 1599/1986 (Greek Government Gazette 75 A’), filled with the data of the applicant natural or legal person, the tax identification number and the competent tax office. In case of a legal person, the application is filed from its legal representative and includes the documents that prove its legal foundation and operation.

b. A copy of criminal records for general use, according to the case (b), paragraph 1, article 150, Law 4070/2012, as applied (it is being ex-officio sought when issued by a domestic authority).

c. A copy of the building permit or building authorization and, depending on the case, the rest of the statutory documents of the case (c), paragraph 1, article 150, Law 4070/2012 as applied.

d. A fire protection certificate concerning the entire establishment, which is issued by the competent fire department, for touristic furnished houses of more than  twenty (20) beds, according to the case (d), paragraph 1, article 150, Law 4070/2012 as applied.

e. Certification of good operation of the accommodation’s sewerage system or certification of connection with the municipality’s sewerage network. Both certificates are issued by the competent office responsible for the operation of the sewerage system, according to the case (e), paragraph 1, article 150, Law 4070/2012, as applied.

f. Topographic diagram of the land designed by an engineer, member of the Hellenic Technical Chamber, in which the house/houses are imprinted as “constructed”, the available areas are displayed, the surrounding area and its configuration is shown, as well as any optional establishments (swimming pools etc). The topographic diagram is filed in two copies on a 1:500 or 1:200 scale.

With the topographic diagram:
f1.   The responsible engineer confirms the location of the land (municipality – area), its surface area and how it is accessed.
f2.   The property title and the building permit or building authorization based on which the building has been constructed are mentioned as well as the parts that maybe have been settled or preserved according to the relevant building legislation.
f3.   The engineer confirms that the present legislation does not forbid the creation of a touristic furnished house in the area where the land is.

g. An engineer’s technical report which confirms the existing houses, their full dimensions, the surface of their internal areas and their capacity (beds, rooms).

h. Formal declarations, according to the article 8, Law 1599/1986 (Greek Government Gazette 75 A’):

h1.   By the applicant or the representative engineer, confirming that the accommodation is built and fulfills all the technical and operational specifications (which are described in this ministerial decree) concerning the land and building.
h2.   By the applicant, confirming that he is the owner of the land displayed in the topographic diagram.
In case of more than one owners of a jointly owned property, there have to be filed either separate declarations or a joint one with the owners data, each owners percentage of joint-ownership and their consent for the issue of the Special Operational Mark to the applicant.  In case a vertical property has already been constructed in the land, the relevant document of establishment and the property’s co-owners regulation have to be presented, to help confirm that the specific use of the property is not forbidden.

i. Environmental Assessment Approval or Standards of Environmental Commitments, if required, according to the case (i), paragraph 1, article 150, Law 4070/2012, as applied.

j. Proof of fee payment, according to the case (h), paragraph 1, article 150, Law 4070/2012, as applied.

 SPECIAL MARK LICENSING

1. The Special Operational Mark of touristic furnished villas or/and houses is issued within ten (10) working days from the submission of all supporting documentation described in Article 5, with no autopsy and provided that all conditions are fulfilled. If the ten days deadline passes with no action whatsoever, the Special Operational Mark is presumed to have been issued according to the Paragraph 4, Article 14, Law 3844/2010 and the interested party may ask the relevant certificate from the competent authority, which is obliged to give it.

2. The validity of the Special Operational Mark is indefinite.

The supporting documentation, the validity of which expires, is necessarily replaced before its expiration date; otherwise the Special Operational Mark is withdrawn upon the decision of the Administrator officer of the competent issuing authority.
Any change concerning the natural or legal person which operates the touristic accommodation entails the issue of a new Special Operational Mark by submitting only: a) concerning touristic furnished villas , the supporting documentation (a) and (f) of the Paragraph 1, Article 5 of this decree as well as the proof of fee payment which equals to the 20% of the demanded value of this specific type of accommodation, b) concerning touristic furnished houses, the supporting documentation (a), (b), (h) of the Paragraph 2, Article 5 of this decree as well as the proof of fee payment which equals to the 20% of the demanded value of this specific type of accommodation. The provisions of the last subparagraph of Paragraph 2, Article 152, Law 4070/2012 as applied, are implemented especially for swimming pools.
